Nancy Van Nest heads our resource recovery and waste-to-energy practice. An in-house and private practice attorney for over 27 years, Nancy has exclusively focused for the past 15 years on legal issues relating to waste recovery, reduction, recycling and reuse, waste-to-energy and other clean technology efforts. She has helped private firms and municipalities develop and implement over $2 billion worth of public-private partnerships (P3s) in waste processing and energy projects across the US and Canada.
Nancy most often provides outside general counsel services to companies focused on organic waste management and water, recycling and energy ventures. She assists cleantech project development teams from initial development through construction and throughout facility operations. Nancy advises on project strategies and delivery methods ranging from design-build to design-build-own-operate and finance models. She is fluent in teaming and EPC agreements, equipment and supply, transportation, and product sales contracts, and project siting matters. With many industry contacts, Nancy is a valued legal and business advisor on all aspects of project development work and has assisted on project finance, special purpose entity and dispute resolution matters. Nancy’s depth of technical knowledge about wastewater treatment, biosolids processing, anaerobic digestion, waste-to-energy, composting and other waste processing systems is crucial to helping clients assess project risk and strategy.
As principal of Van Nest, PC, a specialty practice focused on organic waste facility development and operations, Nancy served for over 13 years as General Counsel to the facilities and development division of Synagro Technologies, Inc., the largest US recycler of organic by-products. Nancy has served as a partner at Bowditch & Dewey, LLP, where she focused on project development work in the waste recycling industry. Nancy began her legal practice in Denver, Colorado, ultimately serving as a firm managing partner focused on business and commercial real estate development. She also served as Corporate Counsel at Cenveo, Inc. where she advised over 200 commercial printing plants on contract, real estate and operational issues.
Nancy is a graduate of Stanford University (BA 1980), the University of Denver (MA 1985, with honors), and the University of Colorado (JD 1988, with awards), and is admitted to practice in Massachusetts. An entrepreneur at heart, Nancy once owned and operated a business news publishing company, and she currently owns Skyfields Flower Farm, LLC, a specialty cut flower farm in Groton, Massachusetts.
