Permitting/Land Use Matters

Representative permitting/land use matters in which our attorneys have been involved include:

  • Provided assistance to free-flow hydropower company in assessing applicability of various permitting requirements with respect to demonstration project.
  • Represented Town of Orleans, MA with respect to all facets of town-sponsored community-scale wind energy project, including permitting (state environmental impact review, Article 97 approval, local zoning review, utility interconnection), contracting (wind energy lease, power purchase agreement terms, agreements with the Massachusetts Renewable Energy Trust’s Community Wind Collaborative) and procurement (request for proposals from private developers).
  • Assisted residential and commercial developers in development and implementation of permitting strategies, including with respect to environmental impact review.
  • Represented waste-to-energy facility in successful bid for local permits for Clean Air Act retrofit and defense of court challenges to permits issued.
  • Successfully defended waste-to-energy facility against citizen lawsuit challenging solid waste facility site assignment.
  • Successfully defended court challenge to permit for landfill restoration project in southeastern Massachusetts.
  • Represent Town of North Andover, MA with respect to enforcement of conditions attached to site assignment for recycling facility and transfer station.
  • Represent citizens group in opposition to increased corporate jet and commercial aviation at Hanscom Airport in Massachusetts via participation in federal and state environmental impact review, historical impact review, wetlands permitting and other regulatory proceedings.
  • Represent citizens opposed to construction of high-voltage electric transmission line near their homes due in part to concerns about unsafe levels of EMF exposure.
  • Represented interested citizens before a local board of appeals with respect to successful opposition to expansion of “big box” retailer.
